We have all experienced a situation in which a worker is not performing up to our company’s standards and has been asked by management to improve their performance.  What should an employer do if this action results in the employee’s termination and the employee filing a Workers’ Compensation Claim? 

We will discuss the Post Termination defense which is often used to defend workers compensation claims in the beginning stages of a case.  This defense can apply to both specific and cumulative trauma claims.  We will discuss the “Good Faith Personnel Action” defense as a tool in defending against a claim asserting a psychiatric claim caused by an industrial accident.
